ULLSWATER SWIM PLACE (USP) – Terms & Conditions

‘Colin Hill Swims’ is trading as ‘Ullswater Swim Place’


AGREEING TO THE T&Cs:

By ticking the box on the booking system stating, "I have read and agree to the terms & conditions", you have agreed to the following conditions of booking:

REFUNDS:

CANCELLATION BY THE PARTICIPANT
If the participant is unable to make a booked and paid for swim session, then no refund will be given.  Changing to an alternative date is only possible one week (7 days) prior to the swim session*.   Any cancellation due to COVID rules, then a Gift Voucher will be issued, if a refund is possible by emailing swim@ullswaterswimplace.com

*Length of Lake Swim – due to scheduling no refunds or transfers are allowed for length of lake guided swims.

SWIM CANCELLATION BY USP:
If USP are unable to hold the swim on the chosen date due to circumstances beyond our control, USP will attempt to restage the swim at the earliest possible date, otherwise a full refund minus processing fee will be given. USP has no responsibility for any additional costs incurred such as travel and accommodation. 

Gift Vouchers & Block bookings:
All block bookings and gift vouchers are valid for one year from the date of booking.


EVENT SAFETY:
USP coaching/group coaching (not solo length of lake swims) participants must wear a tow-float throughout the swim. This is a safety precaution to help visibility in the water. It is not a life saving device and cannot be treated as such. It is up to the individual to be able to swim the distance in varying weather conditions, as a tow-float will not prevent a swimmer from drowning.

AGE LIMIT:
Participants under 16 years on the day of the event, must be accompanied by an adult.  Minimum age limits apply to different events. 


  • Length of Lake Swims – over 16

  • Kailpot Wild Swims – over 12

  • Cross Lake Swims – over 13 (with suitable experience)

  • Endless Pool over 10 (with adult supervising)

  • Open water coaching – over 13 (with suitable experience)

 

MEDICAL:
Open water is a strenuous exercise. Before undertaking a challenging event and to avoid any doubt in your health and fitness, you should undertake a medical check-up. For length of lake swims a medical document must be produced and signed by your GP, state reference to your intended swim, and emailed before your swim. If you have been ill or have experienced a change in your wellbeing or physical state such as pregnancy, please consult a doctor.

TRAINING FOR OPEN WATER:
Length of lake swimmers must train in open water before participating in the event. It is your responsibility to make sure that you are fully prepared, and the event organisers cannot be held responsible for any lack of preparation on your part. When open water swimming down the length of a lake you may encounter varying conditions such as cold water, waves and choppy water. You should be prepared for varying types of weather by regular outdoor swimming.

During the session all swimmers must follow and comply with the instructions given by safety staff including the appropriate distance from the support boat. This includes instructions once the swim has started, where the event may be halted due to reasons beyond our control such as, but not limited to: lightning, bad weather, or a serious incident during the event.

NONCOMPLIANCE:
We reserve the right to evict you from the event for the safety of yourself and/or the events integrity. This includes, but is not limited to:
a) Taking someone else's entry, so the event does not have the correct details for the participant.
b) Causing offense to any staff member or event participant.
c) Appearing to be under the influence of drugs or alcohol.

USP  has the right to alter the timetable and structure of the session up to and including the day of the events. The direction of the swim may be altered depending on the prevailing wind direction.

USE OF IMAGES:
USP reserve the right to use images on print and digital media of you taking part in the event.

LIABILITY:
USP will not be liable to you for the following:

a) Loss or theft on or around the session site, marina and car park
b) Any loss of fundraising money due to your non-completion of the event for whatever reason
c) Injury or sickness due to the participant's negligence
d) Failure to complete the swim distance.
e) If a swimmer is slower than the agreed time limit and the cut off time for the swim is reached. We need to keep our boat pilot's safe, to keep you safe. Details of each time limit is on each event and entry page, where applicable.

f). Medical issues arising from participants undertaking long distance swimming and the stresses put on the participant.
